MINUTES OF A MEETING OF PURLEIGH PARISH COUNCIL, HELD IN THE WELLS PAVILION, HOWE GREEN ROAD, ON FRIDAY, 14th SEPTEMBER 2007, AT 7.30 P.M. Members present: Mr. S. Potter (Chairman), Mr. K. Ascott, Mr. L. Cooper, Mr. K. Gower, Mrs. S. Owen, Mr. M. Perriman, Mrs. M. Stock, Mr G. Strathern. Also in attendance: Mrs. Jane Potter (Clerk). Mr John Archer and Mr. John Sears (District Council Ward Members) attended the public session prior to the meeting. PCSO Stephen Butler and four members of the public attended the meeting. 1/09/07. APOLOGIES FOR ABSENCE Apologies were received from Mr. B. Oliver, who was unable to attend the meeting due to another commitment. Mrs. S. Owen and Mr. G. Strathern apologised for their early departure from the meeting for personal reasons. Mrs. Owen left the meeting during discussion of Agenda item 4.2/09/07 and Mr. Strathern during discussion of Agenda item 9.3/09/07. 2/09/07. THE MINUTES OF THE PARISH COUNCIL MEETING HELD ON 10TH AUGUST 2007, having been circulated to all Members, were approved, and signed by the Chairman. At this juncture, with the agreement of all present, the Chairman closed the meeting so that interested parishioners and members of the Purleigh Playing Field Association (PPFA) could discuss:
with the Parish Council. After a forthright exchange of views, during which the lack of effective communication between the Parish Council and the PPFA was highlighted, the meeting was re-convened. 3/09/07. TO DISCUSS ANY MATTERS OF INFORMATION ARISING FROM THE AUGUST 2007 MINUTES: 3.1/09/07 Clerk: 11/08/07 Mobile Library service: Members noted that Jenny Salisbury, Strategic Manager – Community and Civic Values, Essex County Council, had thanked the Parish Council for its comments regarding the recent changes to the mobile library timetable. The County Council were aware adjustments needed to be made and were actively looking at these with a view to publishing revised timetables in November 2007, for implementation in January 2008. The Parish Council’s views would be taken into account as part of this process. 3.2/09/07 Members’: Members did not have any matters arising from the Parish Council meeting held on 10th August 2007 to discuss. 4/09/07 PLANNING MATTERS 4.1/09/07 Decisions taken between meetings: FUL/MAL/07/00804 Construction of a manège. Valentine’s Cottage, Crown Road, Cold Norton, Essex. Mark Ewers and Veronica Jennings. The Parish Council RECOMMENDED APPROVAL, provided that there was no external illumination of the manège after 10.00 p.m. FUL/MAL/07/00911 Change of use of garage and studio to affordable housing unit to replace mobile home (previously removed). Valentine’s Cottage, Crown Road, Cold Norton, Essex. Mark Ewers and Veronica Jennings. The Parish Council RECOMMENDED REFUSAL, on the grounds that that the new dwelling did not constitute an annex or extension which was auxiliary to, and dependent on, the existing dwelling house, so that a separate unit of accommodation would be created in the countryside, outside the area intended for development. FUL/MAL/07/00890 Demolition of existing and erection of replacement dwelling and garages. Valencia, Cold Norton Road, Purleigh, Essex. Mr. and Mrs. R. Johnson. The Parish Council RECOMMENDED APPROVAL. FUL/MAL/07 00916 Convert flat roof to pitched and add new larger porch. Bryn Leigh, Chelmsford Road, Purleigh. Mr. and Mrs. Apthorp. The Parish Council RECOMMENDED APPROVAL. FUL/MAL/07/00684 Replacement dwelling and garage. Brambles, Chapel Lane, Purleigh. Mr. and Mrs. M. Taylor (Amended position of garage). The Parish Council RECOMMENDED REFUSAL, on the same grounds as the original application (See Minute 4.2/07/07). 4.2/09/07 Current applications: FUL/MAL/07/00964 Retention of canopy and canteen facility. Elbistan Kebabs, Milton House, Maldon Road, Latchingdon. Elbistan Ltd. The Parish Council RECOMMENDED APPROVAL. Members noted that the Parish Council had received copies of letters of OBJECTION to applications FUL/MAL/07/00969 and FUL/MAL/07/00970 at Elbistan Kebabs Ltd from four households in Thatchers Croft. Residents were concerned about the excessive noise already emanating from the site and the lack of adherence to permitted operating hours. FUL/MAL/07/00969 Variation to condition 4 imposed upon planning permission MAL/598/84 dated 11 April 1985, to allow extension of one hour in the morning for food preparation and four hours in the evening for washing down procedures. Elbistan Kebabs, Milton House, Maldon Road, Latchingdon. Elbistan Ltd. It was noted that condition 4 of the consent was as follows: ‘No machinery shall be operated and no industrial processes shall be carried out on the premises any time on Sundays or Bank Holidays, and subject to that absolute prohibition in respect of Sundays and Bank Holidays, no machinery shall be operated and no industrial processes carried out on the premises except between the hours of 8.00 a.m. and 12 noon on Saturdays or between the hours of 8.00 a.m. and 6.00 p.m. on other weekdays’. The Parish Council RECOMMENDED REFUSAL, on the grounds that such an expansion, within a residential area, would be detrimental to the residential amenity of adjacent and surrounding properties by virtue of noise and nuisance, and would set a damaging precedent for similar development nearby. The Parish Council also agreed to write to Maldon District Council asking Planning Enforcement Officers to ensure that the permitted operating hours at the site were being adhered to and that there were no caravans being occupied on the site without permission. Members were of the opinion that Elbistan Ltd may have outgrown the Milton House site, which was small and surrounded by residential properties, and that re-locating to alternative, more sustainable premises, might be best solution for the company and nearby residents. FUL/MAL/07/00970 Retention of 6 No. freezers contained within associated substation. Elbistan Kebabs, Milton House, Maldon Road, Latchingdon. Elbistan Ltd. At this juncture, with the agreement of all present, the Chairman closed the meeting in order that an interested member of the public could discuss the application with the Parish Council. After an informative discussion the Chairman re-convened the meeting. Mrs. Owen left the meeting at this point. The Parish Council RECOMMENDED REFUSAL, on the grounds that the noise from the freezers was detrimental to the amenities of nearby residential properties. Members noted that since the District Council had served an abatement notice on the company in January 2007 (which was upheld by the Magistrates Court in April 2007), the company had not taken any action to comply with the enforcement notice by addressing the noise disturbance or abating the nuisance being caused to nearby residents. FUL/MAL/07/00965 Construction of a new two storey dwelling to replace the farmhouse that previously burned down. Purleigh Barns, Cold Norton Road, Latchingdon. Mr. R.W. Jones. The Parish Council RECOMMENDED APPROVAL. 4.3/09/07 Notification of Appeals: Town and Country Planning Act 1990 Appeal by: Mr. D. APPEAL 1 Application Reference No: FUL/MAL/07/00027 Appeal Reference No: APP/X1545/A/07/2041396/NWF Description of development: Construction of barns comprising agricultural store, tractor and machinery store and farm workshop.
APPEAL 2 Application Reference No: FUL/MAL/07/00357 Appeal Reference No: APP/X1545/A/07/2047689/NWF Description of development: Barn comprising agricultural store, tractor and machinery store and farm workshop.
APPEAL 3 Enforcement Reference No: ENF/1233/16/06 Appeal Reference No: APP/X1545/C/06/2024174 Description of development: Without planning permission the unauthorised erection of two agricultural barns. Members noted that appeals had been received by the Planning Inspectorate against the decision of the District Council to refuse planning permission for the above development and to issue an Enforcement Notice. The appointed Inspector would determine the appeals at a hearing to take place on 9th October 2007 at 10.00 a.m. at the Council Offices, Princes Road. It was also noted that the Parish Council had written to the Planning Inspectorate requesting a copy of the appeal decisions. Town and Country Planning Act 1990 Appeal by: Npower Renewables Site Address: Land at Hockley Farm, Hockley Lane, Bradwell on Sea Application Reference No: FUL/MAL/06/00291 Appeal Reference No: APP/X1545/A/06/2023805 Description of development: Construction of a wind farm comprising 10 turbines with a maximum height of 121m to blade tip, substation building, anemometer mast and ancillary infrastructure. Members noted that the Planning Inspectorate had advised that the appeal had been ALLOWED, and planning permission granted for the above development subject to the conditions set out in the formal decision, a copy of which was placed in the circulation folder for Members’ information. 4.4/09/06 Maldon District Council planning decisions: Members noted that Maldon District Council had APPROVED the following applications:

4.5/09/07 Other planning matters: Maldon District Council Annual Planning seminar for Town and Parish Councils: It was noted that the Clerk and Parish Councillors had been invited to attend the 2007 planning seminar, to be held in the Training Room of the Council on Monday, 24th September 2007 and that there would be a choice of two sessions: The District Council had requested advance notice of items the Parish Council may wish to discuss under Agenda Item 5b ‘Over to you’. Places on the seminar would be allocated on a first come, first served basis and had to be pre-booked. It was agreed that Mrs. Stock, the Clerk and the Chairman would attend the seminar, if they were available. 5/09/07 HIGHWAY MATTERS 5.1/09/07 Proposed school keep clear markings: Pump Lane: Members noted that Jackie Roerig (Essex County Council Highways Engineer) had written to the Parish Council on 21st August 2007 confirming that the Parish Council’s request that additional zigzags were installed in Pump Lane between The Westerings and the end of the proposed Bus Stop had been considered, and added to the scheme. Although this may cause objections Mrs. Roerig advised that it was always possible to implement a lesser restriction than advertised should this prove necessary. As always Maldon District Council had to support any proposals and would enforce parking restrictions where problems occurred. Since this correspondence, after having spoken to Denise Edwards who managed the Safer Journeys to School schemes, Mrs. Roerig had requested a site meeting before the proposed restrictions were advertised. The problem being that the school had specifically asked that the section of road between where the County Council was proposing to install a marked bus bay and The Westerings had been set up as an unofficial drop off point for parents, and the school was keen to maintain this facility. At the request of the Chairman, Mr. Oliver had agreed to attend the site meeting on behalf of the Parish Council. Members understood that the site meeting would take place on either the 18th or 21st September. 5.2/09/07 Essex County Council (Maldon District) (Prohibition and Restriction of waiting, Loading and Unloading, On-Street Parking Places and Disabled Parking Places) (Amendment No 1) Order 2007: Members noted that the above Order had been made and would come into effect on 1st October 2007. Purleigh was affected as follows:
Parts of road authorised to be used as street parking places: The Glebe, North side from a point approximately 9.2 metres west of the boundary of numbers 43 and 44 in a westerly direction for a distance of 6.6 metres. Position in which vehicles may wait: Wholly within the designated parking bay. Classes of vehicle: A disabled persons vehicle, an invalid carriage. Days of operation of parking places: All day. Hours of operation of parking places: All hours. Maximum period for which vehicles may wait: All times. 5.3/09/07 Other highway matters: It was agreed to write to Essex County Council requesting the urgent repair of a broken drain cover to the left side of the wood adjacent to the New Hall Farm entrance in Barons Lane. 6/09/07 PLAYING FIELD AND OPEN SPACES 6.1/09/07 Children’s play area: Monthly report: Mr. Perriman reported that that he had carried out his daily inspections of the Children’s Play Area and that all items of play equipment therein appeared to be in a satisfactory condition. Graffiti had appeared on the swing seats however, the chains on the swings were frequently wound up and one gate was still not fitting properly. Removal of the tower, slide and chain bridge: The Parish Council considered a written complaint from the PPFA that the tower, slide and chain bridge had been removed from the children’s play area without consultation with the PPFA or the wider community. The Parish Council confirmed that the equipment had to be removed because it was beyond economic repair and uninsurable. Members acknowledged however that the local community felt ownership of the pavilion, play area and pavilion and would have preferred to be informed in advance that the equipment had to be removed. It was also acknowledged that the PPFA’s fund raising was greatly appreciated by parishioners and that it was a body to whom residents often turned when issues arose about the pavilion and playing field, despite the fact that the facilities had been maintained and managed as a community resource by the Parish Council since 1996. The Parish Council hoped that communication between the two organisations would improve in the future. It was agreed that Mr. Gower and Mr. Strathern would visit Purleigh Community Primary School and ask the children to come up with ideas for, or design, a piece of play equipment which they would like to replace the tower unit with. The Clerk gave Mr. Strathern some play equipment catalogues to help stimulate the children’s imagination. It would be made clear to the children however that the equipment would take a considerable amount of time to purchase and install. The Parish Council would inform the PPFA about this initiative. 6.2/09/07 Other playing field and open space matters: Members noted the contents of a letter from Bernard Steeples (Chairman, PPFA) which expressed the PPFA’s disappointment that the Council had not entered into a detailed dialogue with it about replacement curtains for the pavilion and plans for the future re-decoration of the interior. It was agreed to write to Mr. Steeples, explaining that as a Council, Members would be interested in hearing the organisation’s views about colour schemes for the pavilion and replacement curtains, prior to the setting of the precept 2008/2009 in January 2008. The Parish Council would make it clear that if the PPFA wished to make a contribution to either potential project, it would be appreciated. It was agreed to ask G. J. Lynch Building Contractors to mend the broken tap in the pavilion. The Clerk would also send him an updated snag list of outstanding items to be completed in the pavilion. It was agreed to ask Mr. Lynch once again to remove a shower from the south side of the changing rooms and to use the head from it to replace a recently broken one. 7/09/07 BRITISH FORCES FREE POSTAGE POSITION Members noted that Steve Watson (Chief Executive, Maldon District Council) had written to invite the Parish Council to consider supporting the following motion passed by Tewkesbury Borough Council on 22nd February 2007: ‘This Council is aware of the situation in which British forces and their families who are stationed overseas cannot receive parcels free of charge as they could in 2003. This Council believes that the situation is both an appalling and disgraceful way to treat our dedicated and hardworking troops and their families given the hardships they face in the world’s hotspots and war zones and therefore asks that the Government reinstates this service as a matter of urgency’ Maldon District Council had agreed to support the motion and had written to the Secretary of State for Defence, the Right Honourable Des Browne MP accordingly. At the request of Tewkesbury Borough Council, Maldon District Council had also written to each Parish and Town Council in the District inviting them to express their support and also to write directly to the Secretary of State for Defence. Members noted that it was the Clerk’s understanding that since Mr. Watson’s letter the Government had reinstated this service temporarily until Christmas. Members debated whether or not this was an appropriate issue for the Parish Council to take up and it was then agreed to assess the situation after Christmas. 8/09/07 POST OFFICE CLOSURES – ESSEX RURAL PARTNERSHIP BRIEFING Members noted that the Essex Rural Partnership (managed by the Rural Community Council of Essex) had written to advise the Parish Council that it was working to ensure that communities in rural areas were aware of the intention to close a number of Post Offices across the country, and to provide them with adequate information so that they could respond to the forthcoming consultations, which in Essex were likely to take place in October. To that end the Essex Rural Partnership had circulated a briefing note, which set out some of the history behind the proposals, and had asked the Parish Council to display posters warning local communities of the forthcoming consultation once the dates were known. 9/09/07 FINANCIAL MATTERS 9.1/09/07 To receive a report of receipts: Members received a report of the following receipts:
9.2/09/07 To approve payment of accounts between meetings: Members noted and approved that the following account had been paid between meetings, adhering strictly to the procedures outlined in the Parish Council’s Financial Regulations 5.3 - 5.7.

Mr. Strathern left the meeting during this agenda item. 10/09/07 CORRESPONDENCE Campaign to Protect Rural Essex (CPREssex) Members noted that this organisation’s AGM would be held on Saturday, 6th October 2007 in RCCE House, Threshelfords Park, Inworth Road, Feering. Before the AGM there would be a guided tour of the Kings Seeds factory, which has been part of Kelvedon’s history for over a century. Maldon District Council Dengie Passenger Transport Network Update: Members noted that the main change to the new Stephensons Bus service in the Dengie which affected Purleigh was that in addition to the main network, an additional journey had been added to help passengers get to Maldon. The settlements to benefit were Purleigh Wash (7.48 a.m.), Roundbush (7.50 a.m.) and Mundon at 7.35 a.m. The bus would arrive in Maldon for 8.10 a.m. A copy of the full briefing note was been placed in the circulation folder for Members’ information. 11/09/07 POINTS OF INFORMATION Mr. Cooper informed Members that one of the trees planted in the cemetery to commemorate the Queen’s Golden Jubilee had died, and the second one had recently been reduced to a stump after the hedge had been cut. PCSO Butler provided the Parish Council with an up-date on local policing. He advised that there had been fourteen calls to Purleigh during the preceding month, which was a low number. Crimes had included theft, with other call outs related to an intruder alarm, a suspicious persons sighting, and two nuisance calls. There had been two accidents in Fambridge Road and two sudden deaths. PCSO Butler reminded people to lock their vehicles and secure their premises when left unoccupied. He advised that the pavilion verandah fire had been dealt with and invited anyone interested in local policing to attend the next Neighbourhood Action Panel meeting which would be held at 7.00 p.m. on 17th September in Purleigh Village Hall. PCSO Butler informed Members that since the departure of one of his colleagues, who had been part funded by Great Totham Parish Council, he was now responsible for 23 villages. PCSO Butler concluded by informing the Parish Council that his mobile telephone number was 0795 8379451 and that parishioners could get directly through to him on that number whilst he was on duty. CRIME AND DISORDER ACT 1988 (SECTION 17) Consideration was given to the crime and disorder implications of all decisions made at this meeting. There being no further business, the Chairman closed the meeting at 9.17 p.m.
