MINUTES OF A MEETING OF PURLEIGH PARISH COUNCIL,

HELD IN THE WELLS PAVILION, HOWE GREEN ROAD,

ON FRIDAY, 8th OCTOBER 2010, AT 7.30 P.M.

Also in attendance: Mrs. J. Potter (Clerk).

The meeting was not attended by any members of the public.

1/10/10 APOLOGIES FOR ABSENCE

Apologies were received from Mr. G. Strathern who was unable to attend the meeting due to a prior personal commitment. In the absence of Mr. Strathern, Mr. Oliver chaired the meeting.

Apologies were also received from Mr. John Archer and Mr. John Sears (District Council Ward Members) who were unable to attend the meeting due to a prior civic engagement.

2/10/10 THE MINUTES OF THE PARISH COUNCIL MEETING HELD ON 10TH SEPTEMBER 2010, having been circulated to all Members, were approved, and signed by the Chairman.

3/10/10. TO DISCUSS ANY MATTERS OF INFORMATION ARISING FROM THOSE MINUTES:

3.1/10/10 Clerk: The Clerk did not have any matters arising from the September 2010 Minutes to report to Members.

3.2/10/10 Members’: Members did not have any matters arising from the September 2010 Minutes to discuss.

4/10/10 PLANNING MATTERS

4.1/10/10 Decisions taken between meetings: FUL/MAL10/00717 Change of use from barn to residential. Barn between Ashlea and Red Oaks Farm, Fambridge Road, Mundon. Mr. John Perry.

The Parish Council RECOMMENDED REFUSAL on the following grounds:

  1. The barn lay in a rural area outside any defined settlement boundary and was not of a suitable type, scale or design for re-use for residential purposes.

  2. There was no need for an additional unit of residential accommodation in this setting and change of use would preclude any further rural use or employment potential.

  3. The change of use of the barn would introduce domestic activities into a rural setting and increase pressure on limited rural services.

  4. The barn did not accord with the design principles outlined in Policy CS21 of the Local Development Framework Core Strategy.

  5. There was no evidence that the barn had been used for residential purposes prior to its recent sale and subsequent unauthorised occupation in July 2010. The age of installations cited as evidence by the applicant being no reliable indicator of the time they had spent in situ.

A letter OBJECTNG to this application from an affected parishioner was placed in the circulation folder for Members’ information.

Members noted that the application had since been withdrawn.

4.2/10/10 Current applications: HOUSE/MAL/10/00793 Single storey side extension. Rudley House, Chelmsford Road, Purleigh. Mr. and Mrs. Purcell.

The Parish Council RECOMMENDED APPROVAL, but agreed to complain to the District Council that no measurements had been shown on the plans, which had been drawn to scale instead. Members did not feel that scale drawings were always reliable and preferred to make recommendations on development where the dimensions of it were known.

FUL/MAL/10/00651 Variation to condition 7 of application FUL/MAL/09/00454 – variation to drainage from a reed bed to discharge pipe. Gordene, Howe Green Road, Purleigh. Mr. G. Monk.

Members noted that this was a retrospective planning application and that the work had already been carried out.

The Parish Council RECOMMENDED APPROVAL.

FUL/MAL/10/00844 Demolition of structurally unsound bungalow & various out buildings and erection of a single dwelling with annexe for parents. Minor amendments to previous approval (FUL/MAL/09/01075.) Hill View, Howe Green Road, Purleigh. Mr. R. and Ms. Jane Roberts.

The Parish Council RECOMMENDED APPROVAL.

4.3/10/10 Notification of Appeals: Members noted that the Parish Council had not been informed of any Appeals between meetings.

4.4/10/10 Maldon District Council planning decisions: Members noted that Maldon District Council had APPROVED the following applications:

HOUSE/MAL/10/00635 Erection of single storey building for domestic storage. Grebe House, Chelmsford Road.

TCA/MAL/10/00647 T1 Walnut tree – Slight crown width reduction and lift using cuts of no more than 3cm. Reduce limb over shed by 1m in length. Remove pegs, cutting back to collar. 1 Purleigh Hall Cottages, The Street.

FUL/MAL/09/01068 Erection of a dwelling for an agricultural stockman and specialist cattle isolation building. Land adjacent Crofton, Cold Norton Road.

4.5/10/10 Procedure for speaking at District Council planning meetings: Members noted that Maldon District Council had decided to introduce a facility for public speaking at planning meetings on a trial basis. This meant that the opportunity would exist for members of the public to address the Committee for a short period before the Committee considered and determined the particular application.

The Committee would be prepared to hear from one person objecting to and one person supporting an application, together with a representative of the relevant Parish Council alongside the applicant or their agent and there would be a fixed time limit of 2 minutes for each individual to speak by way of a statement. It was not the intention that the opportunity should be used to question Members or Officers of the Council or for an open discussion on a particular issue.

Members noted that the District Council had emphasised that this facility did not replace, but merely supplemented representations in writing which would continue to be taken into account with equal weight in the decision making process.

Guidance for speakers issued by the District Council were circulated to all Members prior to the meeting.

As the Parish Council would only be given approximately 3 to 5 days notice before being given the opportunity to speak at a planning committee meeting it was agreed that the following policy be implemented on a trial basis:

When considering potentially controversial planning applications at meetings, a Parish Councillor would be nominated to speak at District Council if invited to do so. That Councillor would then put forward the Parish Council’s view (as agreed at the Parish Council meeting) to the committee.

If invited to speak on non-controversial applications, the Clerk would consult the Chairman, Vice-Chairman and the Parish Councillor living nearest to the site of the application to determine whether a Parish Council presence at the committee meeting was necessary.

4.6/10/09 Other planning matters: Essex County Council and Southend-on-Sea Borough Council Joint Waste Development Documents and Issues Paper: The Parish Council was invited to comment on the Waste Development Document. Members noted that the consultation period ended on Thursday, 2nd December 2010. It was therefore agreed to put the paper (and CD) in the Circulation Folder for Members’ consideration.

Any Member who wished the Parish Council to respond to the document would let the Clerk know so that the matter could be put on the November 2010 Agenda.

5/10/10 HIGHWAY MATTERS

5.1/10/10 30 mph speed limit – Hackmans Lane: Members noted that Jackie Roerig (Traffic and Road Safety Engineer, Essex County Council) had confirmed that she had received a response from the Policy Team who had suggested that the two houses after Bramble Cottage be included within the 30mph speed limit (with the appropriate gateway, see Minute 5.1/09/10) but that extending the speed limit as far as Corporation Bridge would be too much.

It was agreed to inform Mrs. Roerig that the Parish Council would like consideration to be given to extending the speed limit in this way.

5.2/10/10 Temporary road closures in the parish: Members noted details of the following road closures.

Fambridge Road: Fambridge Road would be closed for five days from 4th October 2010 between 09:00 and 16:00 from its junction with the B1010 Barons Lane north to its junction with the B1018 Limebrook Way.

Burnham Road: Burnham Road would be closed for five days from 11th October 2010 between 07:30 and 21:00 from its junction with Maldon Road through to the junction with Fambridge Road.

Lodge Lane: Lodge Lane would be closed from 18th October 2010 for five days between 07:00 to 17:00 from its junction with Chelmsford Road to the junction with Birchwood Road.

5.3/10/10 Essex County Council flood management risk assessment: Members noted that Essex County Council had asked the Parish Council to provide it with details of any areas in the parish which were susceptible to flooding so that it could prepare a new local strategy to effectively manage the risk of surface water flooding i.e. flooding caused by rainfall rather than from the coast or main rivers overflowing.

It was agreed to inform Essex County Council that the following locations in the parish were susceptible to surface water flooding:

 

Location: Lodge Lane/Chelmsford Road junction (outside The Limes)

Reason: Faulty drainage system. (Recently, partial kerbing has been installed in front of The Limes to reduce the risk of it being flooded again, but the effectiveness of the kerbing has yet to be tested).

 

Location: Birchwood Road between Little Montrose Riding Stables and Kent Wood

Reason: Total lack of maintenance of the roadside ditches, which as a result have silted up and have been rendered useless.

 

Location: Simmons Lane/Barons Lane junction

Reason: Lack of maintenance of the roadside ditch by the Environment Agency and an inadequate culvert under Barons Lane. The build up of water here then floods across the field to the east and floods across Fambridge Road by its junction with Blind Lane.

 

Location: Maldon Road (in the vicinity of Hazelmere - the only house in the parish which repeatedly floods during periods of heavy rainfall)

Reason: Inadequate culvert under the road by Hazelmere, and a missed opportunity to divert surface water from the recently developed Mapledean Industrial Estate into Deadaway Brook. The surface water from the new development has been allowed to flow into roadside ditches instead, thus increasing the pressure on an already deficient drainage system.

 

Location: Howe Greed Road (opposite Chesters)

Reason: The perpetual surface water is caused by a blocked drain and/or culvert.

 

Location: The Street (in the railway cutting)

Reason: Overgrown grips.

 

Location: Round Bush Lay-by (floods in wet weather opposite the post box and to the side of 2, Silsons Cottages, Fambridge Road)

Reason: Inappropriate resurfacing of the lay-by (tarmac’ lower than the drains in places) and blocked ditches.

 

Location: Slough Lane (in the vicinity of the bridge)

Reason: Topography.

 

Location: Church Hill/Pump Lane junction (particularly Valley Stores and Post Office)

Reason: Lack of maintenance of the roadside ditch in Pump Lane.

 

Location: Walton Hall Lane (in the vicinity of Hoot House)

Reason: Blocked grips.

5.4/10/10 Other highway matters: Tables and benches on the roadside verge adjacent to The Bell Public House: Members noted that concern had been expressed that tables and benches to seat customers had been put out on the roadside verge adjacent to the south side of The Bell Public House, where they adversely affected the privacy of neighbouring properties.

It was agreed to write to the Highways Authority asking them to investigate the matter.

Sunken drain, The Street: It was agreed to report a very deep sunken drain outside Aylesbury Barn to Essex County Council and to ask them to take urgent remedial action.

Superfluous Telephone Box sign: It was agreed to ask the County Council to remove the now redundant Telephone Box sign from the Round Bush lay-by.

6/10/10 PLAYING FIELD AND OPEN SPACES

6.1/10/10 Children’s Play Area: Monthly report: Mr. Perriman reported that he had carried out his weekly inspections of the Children’s Play Area and that all items of play equipment therein appeared to be in a satisfactory condition and that there was no evidence of mole activity. The spring on the gate remained broken however.

6.2/10/10 To consider providing a hard surface on the cricket club shed for ball games: Members noted that Purleigh Cricket Club had great concerns over the proposal to provide a hard surface on the cricket club shed for ball games. According to the Cricket Club the shed was only just adequate anyway and if balls were kicked against it, they would inevitably go over the top and hit the roof of the shed which was not very strong.

In addition, the club was in the process of putting in a practice net on the other side of the shed, which would mean that balls would continually land on it. The club were also concerned about the impact of the noise on the occupants of properties in The Glebe whose houses backed on the playing field near the shed. The Parish Council noted that the Cricket Club had cleared the old net posts at the bottom of the playing field and its suggestion that as the hard base there was no longer used it would be an ideal place to erect a play wall. Members noted that the club also felt that the ball games being played in the road at the moment were just a craze and that constructing a wall may not prevent them from continuing.

Having thoroughly investigated the advantages and disadvantages of installing a hard surface for ball games to be played against on the playing field, it was agreed not to pursue the matter. Mr. Oliver agreed to inform Mr. Steeples (Chairman, Purleigh Playing Field Association) of the Parish Council’s decision.

When informing the Cricket Club of the Parish Council’s decision, the Clerk would ask Mr. Elliott to remove the old mats and carpet which the club were storing in the corner of the pavilion, now that the season was over.

6.3/10/10 Other playing field and open space matters: Oak tree, Lodge Lane: Members noted that in response to another request from the Parish Council for updated information regarding the highly valued specimen Oak tree in Lodge Lane, Jackie Gilbert (Tree Officer, Maldon District Council) had advised that she had written to Marishal Thompson on 28th July asking for answers to specific questions relating to the reports they had sent her.  Mrs. Gilbert was still waiting for a response, but as she expected the company to have to get answers from more than one source, was not too concerned about the time it was taking to receive a reply. Mrs. Gilbert advised the Parish Council that she would serve a provisional Tree Preservation Order in the interim if she felt a response was not forthcoming.  Mrs. Gilbert was particularly interested in the effects of a drain run that lay directly under the extension to the property in Lodge Lane (where the majority of the damage to the dwelling had occurred), which Marishal Thompson had suggested had been adversely affected by the tree.

Damage to the Pavilion : Members noted that between meetings, two window panes in the pavilion had been damaged. The cracked window panes appeared to have been damaged by a football (The Fox & Hounds had been the last team to play before the damage was reported, although the damage could not be attributed to their players). In addition, a hole had been made in one of the pavilion doors. It was noted that Gary Lynch had been asked to repair the damage and had also mended the leaking hot water tap.

7/10/10 PURLEIGH EMERGENCY GROUP

Members noted that further to the Parish Council’s request for clarification regarding the Purleigh Emergency Group’s access to the village hall key (See Minute 7/09/10), Marlene Shepherd (Purleigh Village Hall Management Committee) had verbally advised the Parish Council that she and Mrs. Clark were the current key holders and that the issuing of keys to regular user groups would be reviewed once new hall booking forms had been finalised, accepted, signed and returned.

8/10/10 FINANCIAL MATTERS

8.1/10/10 To consider purchasing a wreath for Remembrance Sunday: It was unanimously agreed to purchase a wreath to be laid at the War Memorial on Remembrance Sunday. The Clerk agreed to provide Mr. Don Nowell with the sum of £25 (from Petty Cash) and to ask him to purchase a wreath, which Mr. Ascott agreed to lay on behalf of the Parish Council at the Remembrance Day Service.

Members noted that the wreath would be purchased pursuant to s137 of the Local Government Act 1972.

8.2/10/10 To receive a Statement of Accounts for the period 1st April 2010 – 30th September 2010: It was proposed and unanimously agreed to approve the Statement of Accounts for the period 1st April 2010 to 30th September 2010:

Bank statements detailing the transactions to date in all four of the Parish Council’s bank accounts for the period 1st April 2010 to 30th September 2010 were available at the meeting for Members’ inspection, as part of the internal audit process.

8.3/10/10 To carry out a financial review 2010/2011 and consider forward estimates 2011/2012: Members considered a detailed breakdown of income and expenditure for the period 1st April 2010 to 30th September 2010; estimated income and expenditure for the financial year 2010/2011 and a breakdown of anticipated income and expenditure 2011/2012.

This review formed part of the Parish Council’s internal audit procedure as required by the Accounts and Audit Regulations 2003, Regulation 6 as amended by the Accounts and Audit (Amendment) (England) Regulations 2006.

8.4/10/10 Legacy from Janet Pawsey: Members noted that the Parish Council had received an interim distribution payment from Miss Pawsey’s estate in the sum of £3,600. It was agreed that as the remainder of Mr. May’s legacy had been spent on new chairs for the pavilion, Miss Pawsey’s legacy should be paid into that account (Barclays Bank High Interest Business Account number 90802476) and the account re-named accordingly.

9/10/10 CORRESPONDENCE

Rural Community Council of Essex (RCCE)

Village Agents review: Members noted that the Village Agent Mid Essex pilot project was reaching its anniversary and funders were reviewing the value of the service. Christine McDonald, Purleigh’s Village Agent, asked if Purleigh Parish Council would be willing to support the project by putting forward its views on the service.

It was agreed to write in support of the principle of the scheme, which provided an accessible point of contact, particularly for more vulnerable members of the community who might appreciate a personal one-to-one service.

Essex Village Shops and Pubs Day: Members noted that this event would take place from 10.00 a.m. on 4th November 2010 in Danbury Village Hall and was a day designed for communities who wanted to protect their remaining services (shops, pubs etc) and facilitate any community wanting to develop their own community shop or pub. The event would consist of workshops and networking opportunities, and would also see the launch of the Rural Enterprise Fund.

Dengie Hundred Group of Parish Councils

The Annual Quiz for the John Mardon Trophy: It was noted that the Annual Quiz would be held in the Royal Burnham Yacht Club on Wednesday, 10th November 2010 at 7.30 p.m. for 8.00 p.m.

It was agreed not to enter a team in this year’s quiz.

Essex Association of Local Councils (EALC)

Employment issues course: Members noted that the EALC was providing a course on employment issues between 09.30 a.m. and 3.30 p.m. in the Foakes Hall, Great Dunmow on Wednesday, 10th November 2010 at a cost of £60 per delegate.

10/10/10 POINTS OF INFORMATION

Cricket Club news: Mick Elliott advised the Parish Council that Purleigh had been promoted to Division 1 of the PDQ North Essex Cricket League and would, next season, be playing some of the bigger clubs in Essex. The club did have some financial concerns however as they would have to pay an extra £40 per match for independent umpires and should they be successful in the league would also have to provide side screens in subsequent seasons. Mr. Elliott thanked the Parish Council for its continued support.

CRIME AND DISORDER ACT 1988 (SECTION 17)

Consideration was given to the crime and disorder implications of all decisions made at this meeting.

There being no further business, the Chairman closed the meeting at 8.42 p.m.
